NOTIFICATION OF FIRST AMENDMENT TO DECLARATION OF RESTRICTIONS

NOTICE IS HEREBY GIVEN that the lots subject to the Declaration of Restrictions have by majority vote duly made upon proper written notification amended the annual assessment set forth in Paragraph 9.02 commencing with the assessment due May I t 19d9 to increase the assessment to $100 .00 per year.

is not paid on or before the 1st day of May, 1989, the said sum shall become delinquent on June 1 , 1989 and bear interest thereon at the rate of 6 percent per annum, That said assessment and any delinquency thereon as a lien upon the lots subject to the Declaration of Restrictions dated the 19th day of October, 1963 and recorded the 21st day of October, 1965 as Instrument No. 4719.

The undersigned, MARY JO BLOOD , President and RICHARD CHANDLER, Secretary/ Treasurer and each of them certify that they are the duly elected President and Secretary/ Treasurer of the Claraboya Homeowners Association which is the successor in interest to the Claraboya Land Company, A California corporation and that the Association in accordance with its By—Laws gave proper notice to all lot owners within the Claraboya Homeowners Association of the modification of the annual assessment to $100.00 per year and that a written vote was taken of all lot owners and that more than 51 percent of all lot owners voted in favor of the increase of the assessment. Therefore, in accordance with the vote of the lot owners and in accordance with the By—Laws of the Homeowners Association and in accordance with the Declaration of Restrictions this notification of amendment is recorded to give notice that each lot is subject to a $100.00 annual assessment commencing May 1, 1989 and that said assessment shall be continued year to year until notification is recorded of any change therein.
